Terms of Service

By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Platinum Driving Tuition - ABN 20 988 336 050.

Provision of Lessons
- You must hold a current Australian driving licence (Class C LRN or C) or equivalent overseas licence and carry it with you at all times during a lesson. All licenses are to be a valid by way of either physical or digital forms and may be checked at instructors discretion
- On-road lessons commence and end at the pre-determined pick-up point, determined at the time of booking the lesson.
- The duration of a standard on-road lesson is one hour, which includes briefing and/or debriefing time.
- Proper footwear must be worn during the lesson. A flat, enclosed and secure shoe is recommended.
- If you do not turn up at the agreed time for your lesson, your instructor will wait 15 minutes and may at the instructor’s reasonable discretion deduct this from the total lesson time. Your instructor will make every possible effort to contact you via text or phone call to any or all of your contact details that we have on file. If you turn up outside these times, your instructor may in his/her reasonable discretion choose not to proceed with the lesson and in such circumstances you will be liable for the cost of the lesson.
- While every endeavour is made to commence the lesson at the scheduled time and with the scheduled instructor, no responsibility can be taken for circumstances beyond our control which may delay the start time or result in a change of instructor. If there are circumstances beyond our control which have delayed the start time of your lesson, we will offer you the full lesson time or, if that is not possible, we will offer you a lesson at another time.
- You must comply with the instructions or directions of your instructor at all times, before or during a lesson.
- We reserve the right to terminate a lesson if:
a. you engage in any behaviour that your instructor determines is reckless
b. you fail to comply with the instructions or directions of your instructor before or during a lesson
c. you fail to comply with any special conditions on your license.

(In the event that a lesson is terminated under the circumstances listed above you will be required to pay the full cost of the terminated lesson.)
-Although we will make every attempt to secure your belongings Neither we nor our driving instructors accept any liability whatsoever for personal property that is left in any instructor supplied vehicle.
- Driving lessons cannot take place in your own vehicle unless you have at least one full lesson with us to assess your driving prior. If your instructor agrees to provide lessons in your own car after this assessment the vehicle owner is obligated to sign a liability waiver agreement. Neither we nor our driving instructors accept any responsibility whatsoever for traffic infringements or accidents resulting from a learner having driving lessons in their own car.

Purchase of Goods and Services
- Prices and availability of our services are subject to change at any time without notice.

- You warrant to Platinum Driving Tuition that all information given by you to us through this site (including your name, contact and address details, credit card details) are correct.
- Platinum Driving Tuition reserves the right to refuse service to anyone for any reason.

Driving Test
- Your instructor will only present you to the Roads and Maritime Services (NSW) if they deem you safe to sit your driving test.
- We do not accept any responsibility whatsoever for the outcome of any driving test.
- Neither we nor our driving instructors accept any responsibility whatsoever if your driving test is cancelled due to any error(s) in your log book unless it is an entry we have made. Instructions on how to fill in the log book properly is presented in your log book so please use due diligence to make sure your log book meets necessary requirements before attending your driving test. If your driving test is cancelled due to any error(s) in your log book, your Driving Test Package fee will be payable in full.
- If you are presented to the Roads and Maritime Services (NSW) for a driving test by one of our instructors but you have booked a wrong test (eg Hazard Perception Test instead of Driving Test) or your test is at a different time or location, your Driving Test Package fee will be payable in full. We will endeavour to confirm all booking details prior to the test.

 

Copyright and Trademark
- All the material on this website is the intellectual property of Platinum Driving Tuition is subject to the federal copyright act of 1968. You must not reproduce or copy any of the material on this website or otherwise incorporate into or store in any other website.

Account Terms

This page contains the most current version of the Terms of Service.

• Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  
• You are responsible for all activity that occurs from your account.
  
• You agree that Platinum Driving Tuition can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  
• You must not post or submit false information to the Service.
  
• You are responsible for maintaining the security of your account and password. Platinum Driving Tuition cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  
• Platinum Driving Tuition has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Platinum Driving Tuition service, for any reason.
  
• Violation of any of the terms or general conditions may result in the termination of your Account.
  
• In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Platinum Driving Tuition has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Platinum Driving Tuition service. Such termination of the Service will result in the deactivation of your Account.
  

Cancellation Rates

• Less than 24 hours notice before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Platinum Driving Tuition.

 

Refund Policy

Fees, cancellations and rescheduling of bookings
- You must give more than 24 hours notice to cancel a lesson booking or your full lesson fee will be payable.
- You must give more than 24 hours notice to reschedule a lesson booking. If a booking is rescheduled by providing less than 24 hours notice the lesson fee could be payable at instructors discretion.
- We reserve the right to reschedule a lesson subject to the provision of reasonable notice.
- We reserve the right to refuse to provide a lesson where you are unfit to operate a vehicle or suspected to be under the influence of drugs or alcohol as reasonably determined by us. Limited liability waiver is expected to be signed at the commencement of your first lesson

-Please note that with the current COV19 pandemic no refunds for prepaid lessons will be issued at this time. Thank you for your understanding

 

Payment Conditions
Accepted payment methods are cash or credit cards (Visa, Mastercard, American Express). A 2% merchant fee is applicable to all card payments for website bookings or at time of lesson

Gift Vouchers
- Gift vouchers are not transferrable or redeemable for cash
- Gift vouchers must be redeemed by the expiry date shown on the gift voucher.
- All bookings are subject to availability and cancellations can only be made in line with Platinum Driving Tuition Cancellation Policy.
- Gift vouchers can be returned before redemption for a refund however a $50 administration fee will be deducted.

 

Promotions, Discounts & Free tuition
Any discounts or free lesson are not transferrable or redeemable for cash.

 

Purchase of Goods and Services

Modifications to Services and Prices

• Platinum Driving Tuition reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  
• Prices of all Services are subject to change with or without notice.
  
• Platinum Driving Tuition shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
  

Vouchers

• Vouchers are non-refundable and cannot be redeemed for cash.
• Unused vouchers cannot be transferred between clients.
• Purchases containing multiple vouchers can only be used by a single person and cannot be split between people.
• Vouchers are valid for 12 months from the date of purchase.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Platinum Driving Tuition for payment processing.
  
• All fees and transactions are in Australian Dollars.
  

General Conditions

• Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Platinum Driving Tuition.
  
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Platinum Driving Tuition customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
  
• You must not transmit any worms or viruses or any code of a destructive nature.
  
• You understand that Platinum Driving Tuition uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  
• Platinum Driving Tuition does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  
• You expressly understand and agree that Platinum Driving Tuition shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Platinum Driving Tuition has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  
• The failure of Platinum Driving Tuition to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  
• You expressly understand and agree that Platinum Driving Tuition shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
